1. Eligibility and Accounts
You must be at least 13 years old to create an account or use SQWK. By using the service, you represent that you meet this age requirement.
You are responsible for maintaining accurate account information and protecting your login credentials. You are also responsible for activity performed through your account.
2. Telemetry and Flight Data
SQWK processes flight telemetry and related metadata so you can review and analyze flight performance. You retain rights to your content, and you grant SQWK a limited license to store, process, and display that data to provide the service.
3. Acceptable Use
You agree not to misuse SQWK, including by:
- Attempting unauthorized access to accounts, systems, or API endpoints.
- Uploading malicious code, malware, or harmful automation.
- Interfering with service reliability, availability, or security.
- Using SQWK in violation of applicable laws or third-party rights.
4. Third-Party Services
SQWK may link to or rely on third-party services and content. Those services are controlled by their own providers and terms, and SQWK is not responsible for third-party availability or policy changes.
5. Intellectual Property
SQWK branding, software, and service materials are protected by applicable intellectual property laws. You may not copy, reverse engineer, or redistribute protected material except as permitted by law.
6. Feature Availability by Plan
Certain features, including data export and extended telemetry retention, are available only on paid subscription plans. Feature availability may change as SQWK evolves. Current plan details are described on the Pricing page.
7. Service Changes and Availability
SQWK may evolve, suspend features, or modify service behavior over time. We aim for reliable access but cannot guarantee uninterrupted availability in all environments.
8. Disclaimer
SQWK is provided on an "as is" and "as available" basis. Flight analytics are informational and are not a substitute for official training, regulatory guidance, or operational decision-making.
9. Limitation of Liability
To the maximum extent permitted by law, SQWK is not liable for indirect, incidental, special, or consequential damages arising from use of the service.
10. Termination
You may stop using SQWK at any time. SQWK may suspend or terminate access for violations of these terms or for security and operational reasons.
11. Changes to These Terms
We may update these terms periodically. Material updates will be reflected by revising the effective date on this page.

13. Service Availability, Subscriptions, and Sunset
SQWK may modify, suspend, or discontinue all or part of the service at any time for technical, operational, legal, security, or commercial reasons. The service is not guaranteed to be available indefinitely or perpetually.
If paid plans are offered, subscription fees provide access only for the purchased billing period and do not create a perpetual or lifetime right to service availability.
Except where required by applicable law or expressly stated otherwise, fees are non-refundable. If we permanently discontinue a paid plan before the end of a prepaid billing period, any remedy will be limited to what is required by applicable law and may include a prorated refund for unused prepaid time.
Where commercially reasonable, we will provide advance notice of material discontinuation and a reasonable opportunity to export available account data before final shutdown.
You may cancel future renewals at any time using the cancellation methods we make available in the product or through support. Cancellation stops future billing and, unless required by law otherwise, remains effective at the end of the current billing period.
14. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-law principles.
15. Dispute Resolution
If you have a dispute with SQWK, we encourage you to email us first at brian@sqwk.io so we can try to resolve it informally. Both parties agree to attempt good-faith resolution before pursuing formal proceedings.
16. Indemnification
You agree to indemnify and hold harmless Owlgo LLC and its officers, employees, and agents from any claims, losses, or damages (including reasonable legal fees) arising from your use of SQWK, your violation of these terms, or your infringement of any third-party rights.
17. Electronic Communications
By creating an account, you agree that we may communicate with you electronically, including service and security emails (such as email verification and password reset) that are necessary to operate your account. Optional flight coaching emails are sent only if you opt in and can be turned off at any time via the unsubscribe link or your account settings, as described in our Privacy Policy.
